Please read this Privacy Policy carefully. By using and accessing any of the Services, you acknowledge that you have read this Privacy Policy and understand the collection, use, and disclosure of your information as described in this Privacy Policy.

1. Personal Information We Collect or Process

When we use the term "personal information," we are referring to information that identifies or can reasonably be linked to you or another person. Personal information does not include information that is collected anonymously or that has been de-identified, so that it cannot identify or be reasonably linked to you. We may collect or process the following categories of personal information, including inferences drawn from this personal information, depending on how you interact with the Services, where you live, and as permitted or required by applicable law:

  • Contact Details: Your name, address, billing address, shipping address, phone number, and email address.

  • Device Information: Information about your device, browser, or network connection, your IP address, and other unique identifiers.

  • Usage Information: Information regarding your interaction with the Services, including how and when you interact with or navigate the Services.

2. Personal Information Sources

  • Directly from You: When you create an account, visit or use the Services, communicate with us, or choose to utilize TrueMed payment or evaluation features.

  • Automatically through the Services: From your device when you use our products or services or visit our websites, and through the use of cookies and similar technologies.

  • From Our Partners or Other Third Parties: Including integrated health savings assessment platforms like TrueMed.

3. How We Use Your Personal Information

Depending on how you interact with us or which of the Services you use, we may use personal information for the following purposes:

  • Provide, Tailor, and Improve the Services: To perform our contract with you, process payments, fulfill orders, process purchases, manage accounts, arrange shipping, facilitate returns, and enable you to post reviews. This includes sharing necessary line-item data with TrueMed to determine product compliance under IRS Code Section 213(d).

  • Marketing and Advertising: To send marketing, advertising, and promotional communications by email, text message, or postal mail.

    • TrueMed Compliance Restriction: We strictly do not use personal health assessment data, Letters of Medical Necessity, or HSA/FSA documentation generated via TrueMed for targeted commercial marketing or lookalike advertising.

  • Security and Fraud Prevention: To authenticate your account, provide a secure payment and shopping experience, detect/investigate fraudulent or malicious activity, and protect systemic safety.

  • Communicating with You: To provide customer support, be responsive to your inquiries, and maintain our business relationship.

  • Legal & Tax Reasons: To comply with applicable law, respond to valid legal processes, and preserve itemized tax records required for regulatory audit validation of qualified medical expenses.

4. How We Disclose Personal Information

In certain circumstances, we may disclose your personal information to third parties for legitimate purposes subject to this Privacy Policy. Such circumstances include:

  • With Shopify, TrueMed, and Service Vendors: Vendors who perform services on our behalf (e.g., IT management, payment processing, HSA/FSA compliance validation, data analytics, customer support, fulfillment, and shipping).

  • With Business and Marketing Partners: To provide general retail marketing services and store advertisements. You can opt out of targeted tracking protocols where applicable.

  • When You Explicitly Direct Us: When you request us or consent to our disclosure of information to third parties, such as selecting a specialized health savings checkout path to submit documentation to external medical evaluators.

  • Corporate & Legal Transitions: In connection with a business transaction like a merger or bankruptcy, to comply with legal obligations (including subpoenas or search warrants), and to defend the rights and safety of our users or the Services.

5. Relationship with Shopify and Third-Party Platforms

The Services are hosted by Shopify, which collects and processes personal information about your access to and use of the Services. You can review the Shopify Consumer Privacy Policy to learn more about their generalized network data treatments.

Similarly, when you select the TrueMed path for HSA/FSA qualification, your personal information is processed in accordance with TrueMed's independent privacy guidelines. We do not control or assume liability for the independent operational security parameters maintained by non-affiliated third-party digital networks.

6. Children's Data

The Services are not intended to be used by children, and we do not knowingly collect any personal information about children under the age of majority in your jurisdiction. As of the Effective Date of this Privacy Policy, we do not have actual knowledge that we "share" or "sell" personal information of individuals under 16 years of age.

7. Security and Retention of Your Information

Please be aware that no security measures are perfect or impenetrable, and we cannot guarantee "perfect security". Any information you send to us may not be secure while in transit. We recommend that you do not use unsecure channels to communicate sensitive or confidential financial or health data.

How long we retain your personal information depends on different factors, such as whether we need the information to maintain your account, provide the Services, comply with regulatory health-savings validation periods, resolve disputes, or enforce contracts.

8. Your Rights and Choices

Depending on where you live, you may have some or all of the rights listed below (e.g., Right to Access, Delete, Correct, or Port your data). These rights are not absolute and may be declined as permitted by law, particularly where financial or health transaction data must be retained for federal tax record-keeping requirements.

You may exercise promotional opt-outs at any time by utilizing the "unsubscribe" links embedded within our emails. Other transactional updates regarding active orders or medical validation filings will continue to be sent regardless of general marketing status.
